⚠️ 不公平合同条款新规｜Unfair Contract Terms

自 2023 年 11 月 9 日起，在与消费者或小企业签的标准格式合同里提出、使用或依赖不公平条款，属于违法，可被处以民事罚款。
Since 9 November 2023 it has been unlawful to propose, use or rely on unfair terms in standard form contracts with consumers or small businesses, and civil penalties apply.

• “小企业”门槛扩大到员工少于 100 人，或年营业额低于 1000 万澳元。
  A small business is now one with fewer than 100 employees or turnover under $10 million.
• 公司最高罚款可达 5000 万澳元或所获利益 3 倍等，以较高者为准。
  Maximum penalties for companies include $50 million or three times the benefit obtained, whichever is greater.
• 2023 年 11 月 9 日之后订立、续约或修改的合同都适用。
  Contracts made, renewed or varied on or after 9 November 2023 are covered.

追讨欠款一般从正式律师函开始，再视金额和对方回应决定是否起诉。
Debt recovery usually starts with a formal letter of demand, then proceeds to court depending on the amount and the response.

⏰ 维州一般合同索赔的诉讼时效是从诉因产生起 6 年（Limitation of Actions Act 1958 (Vic)），不要拖到最后。
In Victoria the general limitation period for contract claims is 6 years from when the cause of action arose — do not leave it to the last minute.
