🧭 澳洲签证被拒或被取消后，有哪些路？
收到澳洲移民局（Department of Home Affairs）的拒签信或取消信后，先不要急着重新递交。
When you receive a refusal or cancellation letter from the Australian Department of Home Affairs, do not rush to lodge a new application.

⏰ 澳洲 ART 复审期限：最容易错过的一步
2024 年 10 月 14 日 ART 取代 AAT 之后，大多数移民复审期限统一为 28 天，以前常说的”21 天”已经过时。
Since the ART replaced the AAT on 14 October 2024, most migration review deadlines are 28 days — the old “21 days” is out of date.

⚠️ 期限从”收到通知”那天开始算，而不是您打开邮件那天。电子邮件和 ImmiAccount 通知一般按发送当天计算。具体以您的拒签信写明的期限为准。
The clock starts from notification, not from when you open the email. Email and ImmiAccount notices are generally treated as received on the day they are sent. Always follow the deadline in your letter.

移民复审期限是法律规定的，ART 一般没有权力延期。晚一天递交，复审就可能被认定无效，后面的司法复核也会受影响。
Migration review deadlines are set by law and the ART generally has no power to extend them. Lodging one day late can mean the review is invalid, which also affects any later judicial review.

谁可以申请复审
- 境内递交、在境内被拒的申请人本人（大多数情况）
The applicant, for most applications made and refused in Australia - 境外递交的配偶签证（如 309/100）、部分有担保人的签证：一般由澳洲的担保人申请
For offshore partner visas (e.g. 309/100) and some sponsored visas: usually the Australian sponsor - 雇主担保的提名被拒：由担保雇主申请
Refused employer nominations: the sponsoring business - 大多数境外递交的旅游签、学生签被拒没有 ART 复审权
Most offshore visitor and student visa refusals have no ART review rights

复审的一般流程
- 按期限递交复审申请并付费（或同时申请减免）
Lodge the review and pay the fee (or apply for a reduction) within time - 整理拒签理由，逐条准备书面陈述和新证据
Address each refusal reason with written submissions and new evidence - ART 审理：多数案件有听证会，可以带翻译；部分临时签证（目前主要是学生签证）按新规可能只做书面审理
Hearing: most cases have a hearing with an interpreter; some temporary visa reviews (currently mainly student visas) may be decided on the papers under new rules - ART 作出决定：维持、改判，或发回移民局重新审理
Decision: affirm, set aside, or remit to the Department
复审期间，如果您原来的过桥签证 A 或 E 与被拒的申请相关、并且复审按时递交，过桥签证一般会继续有效到复审结束后一段时间。没有有效签证的人要尽快处理身份问题。
If your Bridging Visa A or E relates to the refused application and the review is lodged on time, it generally continues until a period after the review ends. If you hold no valid visa, deal with your status urgently.

🚫 澳洲签证取消和品格问题
收到”拟取消签证通知”（NOICC）
移民局在取消签证前，通常会先发通知，给您一个回复期限。这是最好的补救机会，一定要在期限内书面回复并附上证据。
Before cancelling a visa, the Department usually sends a notice of intention with a response deadline. This is your best chance — reply in writing, with evidence, within the time given.
品格取消（s501）

Non-mandatory s501 decisions in Australia: generally 9 days to apply to the ART - 强制取消（s501(3A)）：不能直接找 ART，而是在通知后 28 天内向移民局申请撤销取消
Mandatory cancellation (s501(3A)): not reviewable by the ART directly; request revocation from the Department within 28 days - 品格问题会影响以后几乎所有签证，建议尽早让专业人士评估

⚖️ 司法复核：ART 维持拒签后向 FCFCOA 上诉
如果 ART 维持拒签，可以在 ART 决定之日起 35 天内向联邦巡回和家庭法院（FCFCOA）申请司法复核（Migration Act 第 477 条）。法院在符合司法利益时可以延期，但不要依赖延期。
If the ART affirms the refusal, you can apply to the FCFCOA for judicial review within 35 days of the ART decision (section 477 of the Migration Act). The court may extend time in the interests of justice, but do not rely on it.

🔄 重新申请、Section 48 和部长干预
能不能直接重新申请？
有些签证可以重新申请，但在澳洲境内被拒、又没有实质签证的人，常常受 Section 48 限制，只能申请少数几类签证。
Some visas can be re-applied for, but people refused onshore without a substantive visa are often subject to the Section 48 bar and can only apply for a few visa types.

部长干预（Ministerial Intervention）
部长干预是部长个人的酌情权，一般在 ART 作出决定后才能申请，部长没有义务考虑或批准。它不应该是第一选择，更不能代替按期复审。
Ministerial intervention is a personal discretionary power, usually available only after an ART decision; the Minister has no duty to consider or grant it. It should not be your first option or a substitute for a timely review.

You can seek judicial review at the FCFCOA within 35 days of the ART decision, but the court only looks for legal error and will not grant the visa itself; ministerial intervention or a new application may also be options. This needs case-by-case assessment.
复审期间可以留在澳洲、可以工作吗？Can I stay and work in Australia during the review?
如果您的过桥签证 A 或 E 与被拒的申请相关、并且复审按时递交，一般可以继续留在澳洲，工作权利按过桥签证的条件。没有有效签证的人要尽快咨询。
If your Bridging Visa A or E relates to the refused application and the review is lodged on time, you can generally remain in Australia; work rights follow your bridging visa conditions. If you hold no valid visa, seek advice urgently.
