答案是：完全不同。了解澳洲的离婚制度，是保护自己权益的第一步。

is: absolutely not. Understanding Australia’s divorce system is the first step
to protecting your rights.
澳洲离婚的基本条件
Basic Requirements for Divorce in Australia
在澳洲申请离婚，必须满足以下条件：
To apply for divorce in Australia, you must meet the following requirements:
- 分居满12个月 — 这是最重要的条件，必须证明双方已分开居住满一年
Separated for 12 months — the most critical requirement - 婚姻已无法挽回 — 澳洲采用”无过错离婚”制度，不需要证明对方有过错
Irretrievable breakdown — Australia uses a “no-fault” divorce system - 澳洲公民、永居或居住满12个月 — 至少一方满足此条件
At least one party must be an Australian citizen, PR, or have lived in
Australia for 12+ months
⚠️ 重要：澳洲离婚只处理婚姻关系的解除，财产分割和子女安排是独立的法律
程序，需要另外处理。
Important: Australian divorce only dissolves the marriage. Property settlement
and parenting arrangements are separate legal matters.
澳洲离婚需要多长时间？
How Long Does the Divorce Process Take?
整个离婚过程通常需要4至6个月，具体时间线如下：
The entire divorce process typically takes 4 to 6 months. Here’s the timeline:
第一步：确认分居满12个月（1年等待期）
这段时间从双方实际分居开始计算。特别注意：即使住在同一屋檐下，只要能证
明分居状态（如分床、分开生活），也可以算作分居期。
The 12-month separation period begins from the date of separation. Note: you
can be separated while living under the same roof if you can demonstrate you
were living separately.
第二步：提交离婚申请（约2-4周）
向联邦巡回及家庭法院（Federal Circuit and Family Court of Australia）提交申
请，可以单独申请或双方联合申请。申请费用约为$1,060澳元（低收入者可申请
减免）。
Submit your application to the Federal Circuit and Family Court of Australia.
The filing fee is approximately AUD$1,060 (reduced fees available for
low-income applicants).
第三步：送达文件（约4周）
如果是单独申请，需要将离婚申请文件送达对方。这一步骤有严格的法律要求，
送达方式必须符合法院规定。
If applying alone, you must serve the divorce documents on your spouse. There
are strict legal requirements for how service must be carried out.
第四步：法庭聆讯（约1-3个月后）
法院会安排聆讯日期，通常不需要亲自出庭（无子女案件可书面处理）。如有18
岁以下子女，必须证明已为子女作出妥善安排。
The court will schedule a hearing date. In most cases without children, you
don’t need to attend in person. If there are children under 18, you must
demonstrate proper arrangements have been made.
第五步：离婚令生效（聆讯后1个月零1天）
法院批准离婚后，离婚令会在一个月零一天后正式生效。在此之前，双方仍然是
法律意义上的夫妻。
After the court grants the divorce, the divorce order takes effect one month
and one day later.

在中国结婚，在澳洲离婚可以吗？
可以。只要婚姻在中国合法登记，澳洲法院承认该婚姻，你可以在澳洲申请离
婚，无需回中国办理。

recognise it and you can divorce in Australia without returning to China.
配偶在中国，可以在澳洲单独申请离婚吗？
可以，但需要将离婚文件送达在中国的配偶，这个过程相对复杂，需要通过适当

Yes, but you need to serve the divorce documents on your spouse in China,
which involves specific legal procedures. We recommend seeking legal advice
on this process.
离婚会影响我的签证吗？
这是很多华人客户最担心的问题。答案取决于你的签证类型。配偶签证持有人需
要特别注意，离婚可能对签证状态产生重大影响，建议在提出离婚申请前先咨询
移民律师。
This depends on your visa type. Partner visa holders need to be especially
careful — divorce may significantly affect your visa status. We strongly
recommend consulting a migration lawyer before proceeding.
⚠️ 注意：财产分割申请必须在离婚令生效后12个月内提出，逾期将需要法院特
别许可。请务必在此期限内处理财产问题。

很多人以为办完离婚就结束了，但其实还有两件重要的事情需要处理：
- 财产分割 — 房产、储蓄、投资、退休金如何分配
- 子女安排 — 抚养权、探视时间、子女抚养费
这两件事可以在分居期间就开始处理，不必等到离婚令生效。尽早处理，可以减
少不必要的冲突和法律费用。
Property settlement and parenting arrangements can be handled during the
separation period — you don’t need to wait for the divorce to be finalised.
