一、先搞清楚:ART是什么,跟以前的AAT是什么关系First, clarify what ART is and how it relates to the former AAT

    🔄 名称变了,性质没变
    🔄 The name changed, but the function is the same

    ART(Administrative Review Tribunal,行政复审法庭)是原来AAT(Administrative Appeals Tribunal)改革后的名称,负责对移民局的签证拒签、撤销等决定进行”案情复审”(merits review)——也就是重新审视整个案子,可以接受新证据,可以做出跟原决定完全不同的裁决。
    The ART (Administrative Review Tribunal) is the renamed successor to the former AAT (Administrative Appeals Tribunal), responsible for “merits review” of Department of Home Affairs decisions such as visa refusals and cancellations — meaning it looks at the whole case afresh, can accept new evidence, and can reach a conclusion entirely different from the original decision.

    《行政复审法庭及其他立法修正法案2026》于2026年2月9日正式生效,并将在2026年8月10日前全面实施,新规让ART的审理程序更加类似法院,程序要求更严格;自2026年5月18日起,部分移民案件可以完全通过书面材料审理,不再安排口头听证。
    The Administrative Review Tribunal and Other Legislation Amendment Act 2026 received Royal Assent on 9 February 2026 and takes full effect by 10 August 2026, making the Tribunal’s procedures more court-like and procedurally strict. From 18 May 2026, certain migration matters can be determined entirely “on the papers”, without an oral hearing.

    二、如果ART维持了拒签决定,接下来还有什么选择If the ART affirms the refusal, what options remain

      ⚖️ 司法复核:向FCFCOA申请
      ⚖️ Judicial review: applying to the FCFCOA

      如果ART维持了原本的拒签或撤签决定,通常还有一条路:向联邦巡回及家庭法院(Federal Circuit and Family Court of Australia,简称FCFCOA)申请司法复核。
      If the ART affirms the original refusal or cancellation decision, there’s generally still one avenue left: applying for judicial review at the Federal Circuit and Family Court of Australia (FCFCOA).

      另外还存在一个非诉讼的选项——依据《移民法》第351条或417条,向移民部长请求行使个人自由裁量权、以对当事人更有利的方式重新做出决定。这不是一项权利,能否被受理和批准完全取决于部长个人裁量,也不是常规救济途径。
      There’s also a non-litigation option: requesting the Minister for Immigration to personally exercise discretion under sections 351 or 417 of the Migration Act, to substitute a more favourable decision in the public interest. This is not a right — whether it’s even considered, let alone granted, is entirely at the Minister’s personal discretion, and it isn’t a routine remedy.

      三、司法复核到底在审什么What judicial review actually examines

        🚫 不是重新审理案情
        🚫 It is not a fresh hearing of the merits

        这是理解整个流程最关键的一点:司法复核完全不同于ART的案情复审。法院不会重新判断”你的情况够不够充分””签证该不该批”,也不会接受新证据来补强你的案子。
        This is the single most important thing to understand about the whole process: judicial review is fundamentally different from the ART’s merits review. The Court will not re-assess whether your circumstances were compelling enough, or whether the visa should have been granted — and it won’t accept new evidence to strengthen your case.

        🔍 只审查”程序有没有出错”
        🔍 It only examines whether the process went wrong

        法院审查的核心问题是:ART在做决定的过程中,有没有出现”管辖权错误”(jurisdictional error)——比如没有考虑本应考虑的相关因素、考虑了不该考虑的无关因素、没有遵循法定程序、违反程序公正原则、或者在没有证据支持的情况下做出认定。
        The Court’s core question is whether the ART made a “jurisdictional error” in reaching its decision — for example, failing to consider a relevant factor, considering an irrelevant one, failing to follow required procedures, breaching procedural fairness, or making a finding without any supporting evidence.

        ⚙️ 结果只有两种

        法院最终只会做出两种结果之一:驳回申请(维持ART决定),或者认定存在管辖权错误、撤销原决定并发回重新审理。法院本身不会替你做出”该不该批准签证”这个实质性判断。
        The Court will ultimately reach one of only two outcomes: dismissing the application (upholding the ART’s decision), or finding a jurisdictional error and setting the decision aside, sending it back for reconsideration. The Court itself will not make the substantive call on whether the visa should be granted.

        四、截止期限极其严格,这是最容易被忽视的致命细节The deadline is extremely strict — the detail most easily overlooked, and most fatal if missed

          大多数情况下,必须在ART决定作出之日起35天内向FCFCOA递交司法复核申请,这是自然日(calendar days),不是工作日,即使决定书面文件还没有寄到,这个期限依然从决定作出当天开始计算。
          In most cases, the judicial review application must be lodged with the FCFCOA within 35 days of the date of the ART decision — these are calendar days, not business days, and the clock starts from the day the decision is made, even if the written copy hasn’t yet arrived.

          ⏰ 品格类案件:可能仅9天
          ⏰ Character-related cases: sometimes as little as 9 days

          在涉及品格问题(比如第501条相关的签证拒签或撤销)的案件中,某些情况下的申请期限可能短至9天,留给准备和递交材料的时间非常紧张。
          In cases involving character issues (such as refusals or cancellations under section 501), the deadline in some circumstances can be as short as 9 days, leaving very little time to prepare and lodge materials.

          🚫 ART和法院都无法延长这个期限
          🚫 Neither the ART nor the Court can extend this deadline

          这是移民类司法复核区别于很多其他法律程序的地方——这个期限是法定的硬性规定,ART没有权力延长,一旦错过,通常意味着永久失去这条救济途径。
          This is what makes migration judicial review different from many other legal processes — the deadline is a strict statutory requirement that the ART has no power to extend. Missing it generally means permanently losing this avenue of recourse.

          五、司法复核的现实考量Practical considerations around judicial review

            👨‍⚖️ Requires a lawyer — migration agents cannot represent you in court

            司法复核是正式的法院诉讼程序,只有具备执业资格的律师才能代理出庭,这跟ART阶段(移民代理也可以协助准备材料)有本质区别。
            Judicial review is formal court litigation — only a qualified, practising lawyer can represent you in court. This is fundamentally different from the ART stage, where a migration agent can also assist with preparation.

            💰 需要评估现实的成功概率和成本
            💰 Weighing the realistic prospects and cost

            由于司法复核的审查范围非常窄,很多申请人对ART决定的不满其实是对”案情结果”不满,而不是真的存在法律程序错误——这种情况下,司法复核成功的可能性很低,需要有经验的律师先做初步评估,判断是否真的存在值得起诉的法律错误。
            Because the scope of judicial review is so narrow, many applicants’ dissatisfaction with an ART decision is really about the outcome on the merits, not a genuine legal or procedural error — in which case, the prospects of success are low. An experienced lawyer should conduct an initial assessment first, to determine whether a genuinely arguable legal error actually exists.

            📈 法院驳回后,还有更进一步的选择

            如果FCFCOA驳回了司法复核申请,在获得法院许可(leave)的前提下,还可以就”法律问题”进一步上诉到联邦法院(Federal Court of Australia),但这已经是非常靠后段、门槛很高的一层救济,适用情形有限。
            If the FCFCOA dismisses the judicial review application, it may still be possible — with the Court’s leave — to further appeal to the Federal Court of Australia on a question of law. This is a very late-stage, high-threshold avenue with

            六、并非所有ART决定都能走司法复核这条路Not every ART decision qualifies for judicial review

              值得注意的是,有些决定从一开始就不属于ART的复审范围,比如基于ASIO不利安全评估做出的决定、部长依据第501A/501BA条个人做出的决定、以及部分没有境内担保人的境外拒签决定——这类情况的救济途径需要单独评估,具体建议直接咨询专业律师确认。
              It’s worth noting that some decisions fall outside the ART’s review scope from the outset — for example, decisions based on adverse ASIO security assessments, decisions the Minister makes personally under sections 501A/501BA, and certain offshore refusals without an onshore sponsor. Remedies for these situations need separate assessment — we’d recommend confirming directly with a lawyer.

              A:不会。法院只审查ART的决定过程是否存在管辖权错误,不会重新评估你的具体情况够不够充分。
              No. The Court only examines whether the ART’s decision-making process involved a jurisdictional error — it won’t reassess whether your circumstances were compelling enough.

              What’s the deadline for applying for judicial review?

              A:一般情况下是ART决定作出之日起35天,涉及品格问题的部分案件可能短至9天,这个期限无法延长,务必尽早咨询律师。
              Generally 35 days from the date of the ART decision — as short as 9 days for some character-related cases. This deadline cannot be extended, so it’s essential to consult a lawyer as early as possible.

              Q4:移民代理可以帮我处理司法复核吗?
              Can a migration agent handle judicial review for me?

              A:不可以代理出庭。司法复核是正式法院诉讼,只有执业律师才能代理出庭,这跟ART阶段的角色不同。
              Not to represent you in court. Judicial review is formal court litigation, and only a practising lawyer can represent you — this differs from the ART stage.

              Q5:法院驳回司法复核申请后,还能怎么办?
              If the Court dismisses the judicial review application, what options remain?

              A:在获得法院许可的前提下,理论上还可以就法律问题上诉到联邦法院,但这是门槛很高、适用情形有限的最后一层救济。
              With the Court’s leave, it may be theoretically possible to further appeal to the Federal Court on a question of law — but this is a high-threshold, limited last-resort option.
